2. Scope
This Privacy Policy applies to the use of the SaaS platform "nopex console" at https://console.nopex.cloud. It does not apply to self-hosted instances of the software.
3. Data Processed, Purposes, and Legal Bases
3.1 Account Data
When you create and manage an account, we process your email address, your password (stored in encrypted form), and the verification status of your email address. This data is required for account creation, login, and communication with you. The legal basis is Art. 6(1)(b) GDPR (performance of a contract).
You may optionally provide your first name, last name, a profile picture, and your preferred language setting. This information is used to personalize your account. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in a user-friendly platform experience).
3.2 Session Data
Each time you use the platform, your IP address, browser identifier (user agent), and session timestamps are collected. This data is used for authentication, security, and abuse prevention. The legal basis is Art. 6(1)(b) GDPR (performance of a contract) and Art. 6(1)(f) GDPR (legitimate interest in platform security).
3.3 Registration Abuse Prevention
When you register an account, Cloudflare Turnstile processes technical request data, including your IP address, browser information, and the website hostname, to distinguish legitimate registrations from automated abuse. Nopex receives and validates a short-lived challenge token but does not store that token in your account. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in protecting the platform and its users against automated abuse). Further information is available in Cloudflare's Turnstile Privacy Addendum.
3.4 Organization and Usage Data
To provide platform functionality, we process your organization name, memberships, project assignments, and roles. The legal basis is Art. 6(1)(b) GDPR (performance of a contract).
We also process billing reference data such as your subscription ID and credit balance for billing and account management purposes. The legal basis is likewise Art. 6(1)(b) GDPR (performance of a contract).
Payment details (e.g., credit card numbers) are not stored directly by us but are processed by our payment service provider (see Section 6).
3.5 AI Usage Data
We process data on token consumption and cost per AI call for billing purposes. The legal basis is Art. 6(1)(b) GDPR (performance of a contract).
We also store AI task history, which includes task descriptions, AI summaries, duration, and costs. This data is used for usage analytics and billing. The legal basis is Art. 6(1)(b) GDPR (performance of a contract) and Art. 6(1)(f) GDPR (legitimate interest in usage analytics).
Raw token consumption data is aggregated after 2 days; the raw data is then deleted. Aggregated data is retained for billing purposes.
3.6 Data Transmitted to AI Providers
When you use AI features of the platform (e.g., Swarm, Chat), the following data is transmitted to external AI providers (see Section 6):
- User prompts (chat messages, task descriptions)
- Project source code (files in the Git repository)
- Project documents (uploaded files)
- Conversation history (previous messages in the session)
- File attachments
Important notice: Please be aware that inputs to AI features are transmitted to external providers without automatic filtering. Please do not enter special categories of personal data within the meaning of Art. 9 GDPR into AI features.
Nopex contractually ensures that the AI providers used do not use your data for training or improving their AI models.
Some AI providers are based in the United States. Transfers are made on the basis of Standard Contractual Clauses (SCCs) pursuant to Art. 46(2)(c) GDPR (see Section 6 for details).
Legal basis: Art. 6(1)(b) GDPR (performance of a contract — provision of AI features as part of the contractual service).
3.7 Error Data
For troubleshooting and operational reliability, we process technical error messages, stack traces, request URLs, HTTP headers, IP addresses, and browser identifiers. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in stable and secure operations).
3.8 Transactional Emails
Your email address is used to send verification, password reset, invitation, and notification emails. The legal basis is Art. 6(1)(b) GDPR (performance of a contract).
3.9 Product News by Email
When you register, the checkbox for product news is already ticked. If you leave it ticked, we use the email address you provided at registration to inform you about new features and offers relating to the nopex console and similar services of ours. If you untick it, you will not receive product news; this has no effect on your use of the platform.
If you register with an external sign-in provider (e.g., Google or Microsoft), no checkbox is shown. In that case product news is enabled for the email address provided by the sign-in provider, and we inform you about your right to object during registration and in every product-news email. You can turn product news off at any time as described below.
You may object to the use of your email address for product news at any time, without incurring any costs other than the transmission costs according to the basic rates. You can do so via the unsubscribe link contained in every product-news email, in the notification settings of your account, or by sending an email to [email protected]. We point this out when collecting your email address and in every product-news email.
The legal basis is § 7(3) of the German Act against Unfair Competition (UWG) in conjunction with Art. 6(1)(f) GDPR (legitimate interest in direct marketing of our own similar services). Product-news emails are sent via Brevo (see Section 6).
3.10 Interactions with Lifecycle Emails
Certain emails concerning registration, usage limits, an open checkout, or an interview you requested contain individual links protected against modification. A link associates its use with the specific email delivery and your user account. These links first serve their respective function: opening the console or a questionnaire, continuing a checkout, opening an appointment-booking page, or unsubscribing from emails.
Separately, we record interactions with these emails. When a link to the console, questionnaire, checkout, or appointment-booking page is requested, we store the time of the first request. Since automated link checks can trigger such requests, we separately store the first and latest visit confirmed by a page visible in the browser. A successful unsubscribe is also stored as an interaction. In the internal Mails area, authorized staff see resulting figures aggregated by distinct recipient; it does not display a list of individual recipients or deliveries.
For emails about registration, the usage-limit questionnaire, and checkout reminders, we attribute a checkout begun within 30 days after the latest confirmed visit to the relevant email. We also attribute the first positive payment from that checkout. The 30 days are an attribution window, not a deletion period. For an appointment email sent after you requested an interview, a confirmed visit to the booking link also updates the interview contact status. We do not infer that an appointment was booked from the visit.
When open measurement is configured at Brevo, Brevo can detect that an email was loaded through an image embedded by the provider and report that event to us using a random identifier for the individual delivery. We store the earliest reported image load. An image load does not prove that a person read the email, and not every open can be detected, for example when images are blocked. The internal “Opened” figure counts distinct recipients with at least one measured image load and no stored interaction such as a confirmed link visit, checkout, payment, or successful unsubscribe. If no image load was measured for the selected cohort, the figure remains unavailable rather than being shown as zero.
3.11 Origin of Your Registration (Campaign Attribution)
To understand which of our websites, campaigns, and ads lead to registrations, we record how you reached the nopex console. This information is collected for the first visit that brought you to us via a campaign or an external website ("first touch") and for the most recent such visit ("last touch"):
- campaign parameters contained in the address you used (e.g., "utm_source", "utm_medium", "utm_campaign", "utm_term", "utm_content", "utm_id");
- click identifiers that advertising networks add to the address when you click on an ad ("gclid", "gbraid", "wbraid", "msclkid", "fbclid", "li_fat_id", "ttclid", "twclid", "epik", "dclid", "rdt_cid");
- the landing page (host name and path, without query parameters);
- the host name of the referring website, if you came from an external website;
- the time of the respective visit; and
- a random journey identifier ("nx_aid", 32 characters) generated by our websites. It does not contain any information about you and is not derived from your device data.
This information reaches the console in one of the following ways:
- With your consent (see Section 4.2), our websites www.nopex.cloud and business.nopex.cloud store it in the cookie "nopex_attr" on the domain .nopex.cloud. The cookie expires 90 days after the first touch; later visits do not extend this period. The console reads this cookie.
- Without your consent, nothing is stored on your device for this purpose, except the short-lived hand-off cookie "nopex_signup_attr" during a sign-up with an external sign-in provider (see Section 4.1). Instead, our websites carry the information from page to page and over to the console as an encoded parameter in the page address ("nx_t"). This parameter is valid for no more than 2 hours and is ignored afterwards. It remains in the address bar while you browse our websites, and it also stays in the console's address bar while you register; the console removes it only if the cookie "nopex_attr" already exists. We never include it in the addresses we report to analytics tools or to advertising networks. If you share a link that still contains "nx_t" within this period, the recipient's registration may be attributed to your visit.
- In addition, the console reads campaign parameters and click identifiers directly from the address you arrive with.
Until you register, the console keeps this information only in the memory of the open page; it is not written to the browser's local or session storage and is lost when you close the page. When you register, we store the information on your account — regardless of whether you have consented. We use it internally to evaluate which campaigns and pages lead to registrations and orders. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in measuring the effectiveness of our marketing and allocating our marketing budget accordingly). You may object to this processing at any time (Art. 21 GDPR).
Click identifiers are passed on to advertising networks only with your consent to the "Marketing" category (see Section 4.4). Without consent they remain with us. We do not read cookies set by advertising networks or by Google Analytics ("_ga", _ga_<ID>, "_gcl_aw", "_fbp", "_fbc", "_ttp", "_rdt_uuid") unless you have consented. With your consent, the console reads these cookies, which the respective providers set on the domain .nopex.cloud via our websites, stores their values on your account at registration, and passes each value only to the provider that set it, as described in Section 4.4.
4. Cookies and Tracking
4.1 Strictly Necessary Cookies
The platform uses the following cookies without asking for your consent, because they are strictly necessary to provide the service you request (§ 25(2) no. 2 TDDDG):
- "authjs.session-token" — authentication and session management, stored for 7 days.
- "nopex_link_intent" — OAuth account linking, expires after 10 minutes.
- "nopex_signup_attr" — hand-off of the registration data described in Section 3.11 when you sign up with an external sign-in provider (e.g., Google or Microsoft). Your browser leaves the console for the provider's sign-in page, and this cookie carries the data across that round trip. It is set immediately before the redirect, expires after 10 minutes at the latest, and is deleted as soon as it has been read. It contains the values of advertising and analytics cookies only if you have consented.
- "nopex_consent" — stores your consent decision (see Section 4.2), 12 months.
- "NEXT_LOCALE" and "NEXT_TIME_ZONE" — your language and time zone, 12 months.
- "sidebar_state" — whether the navigation sidebar is expanded, 7 days.
- "nopex_consent_synced" (local storage of your browser, not a cookie) — records which consent decision this device last synchronised with your account, together with your user ID, so that the decision is not transmitted again on every page load. It remains until you sign in with another account or clear your browser data.
The legal basis for the processing associated with these cookies is Art. 6(1)(b) GDPR (performance of a contract) and, for "nopex_consent", Art. 6(1)(f) GDPR (legitimate interest in documenting and respecting your decision).
4.2 Your Consent Decision
We ask for one consent decision that applies to www.nopex.cloud, business.nopex.cloud, and console.nopex.cloud alike. If no decision has been made yet, the console shows the same banner as our websites. A single decision covers both categories, "Analytics" and "Marketing".
Your decision is stored in the cookie "nopex_consent" on the domain .nopex.cloud (12 months). A decision you make on one of these sites therefore also applies on the others, and you are not asked again. Once you have registered, we also store your decision on your account. If you sign in on a new device, we restore the cookie from your account without showing the banner again. To keep the cookie and your account in step, the browser notes in its local storage ("nopex_consent_synced", see Section 4.1) which decision it last synchronised for your user ID. If you grant consent within 7 days after registering, we transmit your registration event to the marketing recipients listed in Section 4.4 subsequently.
You can withdraw or change your consent at any time with effect for the future, via "Cookie settings" on the sign-in and registration pages or under Account Settings → Analytics & marketing. A change made while you are signed in is also stored on your account. When you withdraw consent, we delete the cookies "nopex_attr" and "nopex_signup_attr" and discard the journey identifier held in your browser. Events that were already transmitted before your withdrawal are not recalled; the lawfulness of processing carried out before the withdrawal remains unaffected.
Without consent, the platform works without restriction. In that case we do not read advertising or analytics cookies, do not pass click identifiers to advertising networks, and send only the anonymous Google Analytics events described in Section 4.4. Campaign attribution (Section 3.11) and Umami (Section 4.3) work independently of your decision.
4.3 Umami (Always Active)
We use Umami Cloud, a cookie-free web analytics service operated by Umami Software, Inc., San Francisco, United States (cloud.umami.is). We do not host Umami ourselves. Our websites and the console share one Umami property, so that a visit to our websites and a subsequent registration in the console can be evaluated as one journey.
The Umami script is loaded from cloud.umami.is on every page of the console. It does not set cookies and does not store an identifier on your device. Umami processes your IP address transiently to derive an approximate location (country, region, city); we do not receive your IP address from Umami. The following data is processed:
- page views (page address including any campaign parameters and click identifiers it contains, but without "nx_aid" and "nx_t"; page title, referring website, browser, operating system, device type, screen size, language);
- events in your browser, such as viewing and submitting the registration form, completing registration ("signup_complete"), confirming your email address, signing in, and using individual features;
- for the "signup_complete" event additionally: the selected plan, the sign-up method, and the campaign data from Section 3.11, i.e., campaign parameters, landing page, host name of the referring website, and the click identifiers themselves;
- the journey identifier "nx_aid" (Section 3.11), which we pass to Umami so that pages visited on our websites and in the console are attributed to the same visitor.
After you sign in with an external sign-in provider, a short-lived cookie "nopex_auth_event" tells the console to report the registration or sign-in event to Umami. It expires after 5 minutes at the latest and is deleted as soon as it has been read.
Some events that occur without your browser, such as the creation of an organization or project and orders, are reported to Umami by our servers. These events carry the journey identifier, if one is known, or a pseudonymous identifier derived from your user ID by a one-way hash. Where the event is triggered by a request from your browser, our server passes on your browser identifier (user agent); it does not pass on your IP address.
Purpose: understanding how the console is used and which pages and campaigns lead to registrations. Legal basis: Art. 6(1)(f) GDPR (legitimate interest in understanding product usage and the effectiveness of our marketing). You may object to this processing at any time (Art. 21 GDPR), for example by email to [email protected]; you can also prevent the script from loading with common content blockers. Please note that it is not conclusively settled whether reading browser and device information through such a script without consent falls under § 25(1) TDDDG.
Umami Software, Inc. acts as our processor under a data processing agreement pursuant to Art. 28 GDPR. Data may be processed in the United States; transfers are based on the EU Standard Contractual Clauses (Art. 46(2)(c) GDPR).
4.4 Google Analytics and Advertising Networks
None of the following tools runs a script or sets a cookie in the console. All events are transmitted from our servers. You can change your consent at any time as described in Section 4.2.
- Google Analytics 4 (server-side only) — events are sent via the GA4 Measurement Protocol to measure registration, onboarding, and order funnels. Recipient: Google Ireland Limited; data may be transferred to the United States under Standard Contractual Clauses.
- With your consent to the "Analytics" category: registration, completed onboarding, orders, and plan changes, together with a stable client ID and a pseudonymous user ID. The client ID is taken from the "_ga" cookie of our websites if present and you have consented; otherwise we generate one and store it on your account. Session information from the
_ga_<ID>cookie is passed on as well. Legal basis: Art. 6(1)(a) GDPR (consent). - Without your consent: only the events "registration" and "order" are sent, each with a random client ID that is newly generated for every single event and is not stored, and without a user ID. The events contain the selected plan and the campaign parameters ("utm_…") or, for orders, the amount, currency, and our internal order and project reference. Since they are sent from our servers, Google does not receive your IP address or browser information with them. We do not transmit any identifier that allows Google to link these events to you. Orders for the same project, however, carry the same internal project reference and can therefore be linked to each other. Purpose: counting registrations and orders to assess and model the effectiveness of our advertising. Legal basis: Art. 6(1)(f) GDPR (legitimate interest in measuring the success of our marketing). You may object to this processing at any time (Art. 21 GDPR), e.g., by email to [email protected].
- With your consent to the "Analytics" category: registration, completed onboarding, orders, and plan changes, together with a stable client ID and a pseudonymous user ID. The client ID is taken from the "_ga" cookie of our websites if present and you have consented; otherwise we generate one and store it on your account. Session information from the
The following recipients receive data only with your consent to the "Marketing" category. Legal basis: Art. 6(1)(a) GDPR (consent). Each provider receives only its own click identifier and its own cookie values.
- Meta Conversions API — registration and order events (orders with amount and currency) are transmitted to Meta for attribution of Meta ad campaigns. They carry your hashed email, a hashed user ID, your IP address and user-agent, the campaign source and campaign name ("utm_source", "utm_campaign") for registrations, our internal order reference for orders, and the Meta identifiers "_fbc" (derived from the click identifier "fbclid") and "_fbp" if available. Recipient: Meta Platforms Ireland Limited; data may be transferred to the United States under Standard Contractual Clauses.
- LinkedIn Conversions API — registration and order events (orders with amount and currency) are transmitted to LinkedIn with your hashed email and, if you arrived via a LinkedIn ad, the LinkedIn click identifier ("li_fat_id") for attribution of LinkedIn ad campaigns. Recipient: LinkedIn Ireland Unlimited Company; data may be transferred to the United States under Standard Contractual Clauses.
- TikTok Events API — registration and order events (orders with amount and currency) are transmitted to TikTok for attribution of TikTok ad campaigns. They carry your hashed email, a hashed user ID, the TikTok click identifier ("ttclid") if you arrived via a TikTok ad, the TikTok cookie "_ttp" if available, and your IP address and user-agent. Recipient: TikTok Technology Limited, Ireland; data may be transferred to third countries, including the United States and Singapore, under Standard Contractual Clauses.
- Reddit Conversions API — registration and order events (orders with amount and currency) are transmitted to Reddit for attribution of Reddit ad campaigns. They carry your hashed email, a hashed user ID, the Reddit click identifier ("rdt_cid") if you arrived via a Reddit ad, the Reddit cookie "_rdt_uuid" if available, and your IP address and user-agent. Recipients: Reddit Netherlands B.V. and Reddit, Inc., United States, each acting as an independent controller for this data. Data is transferred to the United States under the EU-US Data Privacy Framework, with Standard Contractual Clauses as a fallback.
- Google Ads — registration and order events (orders with amount and currency) are transmitted to Google Ads via the Google Data Manager API for attribution of Google Ads campaigns. They carry your hashed email and, if you arrived via a Google ad, the Google click identifier ("gclid", "gbraid" or "wbraid"). Recipient: Google Ireland Limited; data may be transferred to the United States under Standard Contractual Clauses.
- Microsoft Advertising — if we run campaigns on Microsoft Advertising (Bing), registration and order events (orders with amount and currency) are transmitted to Microsoft via its offline-conversion interface for attribution of these campaigns. They carry your hashed email and, if you arrived via a Microsoft ad, the Microsoft click identifier ("msclkid"). Recipient: Microsoft Ireland Operations Limited; data may be transferred to the United States under the EU-US Data Privacy Framework and Standard Contractual Clauses.
5. Retention Periods
Retention periods depend on the respective data category:
- Account data — We retain your account data until you delete your account. After deletion, we retain it only to the extent required by statutory retention obligations (e.g., §§ 147 AO, 257 HGB).
- Unverified registrations — Accounts that remain unverified for approximately 30 days are automatically deleted, unless they share an organization with another member or have a paid subscription.
- Session data — Session data is automatically deleted after 7 days.
- Organization and usage data — Organization and usage data is retained until the organization account is deleted, then removed within 30 days unless statutory retention periods apply.
- AI task history — AI task history is retained until the user account or the associated project is deleted.
- AI usage data (raw) — Raw data is aggregated after 2 days and then deleted.
- AI usage data (aggregates) — Aggregated AI usage data is retained for billing purposes for the duration of the contractual relationship.
- Campaign attribution data — The data described in Section 3.11 is stored on your account until you delete your account or object to the processing. The cookie "nopex_attr" expires 90 days after the first touch, and the address parameter "nx_t" becomes invalid after 2 hours.
- Consent decision — The cookie "nopex_consent" expires after 12 months. The decision stored on your account is kept until you delete your account.
- Analytics event records — Our records of the events transmitted to the tools named in Section 4 are deleted 90 days after the event once delivery is complete; records with a failed delivery are kept until the failure has been resolved.
- Error data — We have configured Sentry to automatically delete error data after 90 days.
- Email delivery data — Transactional email log data is stored by Brevo for a maximum of 30 days.
